ITAR ‑ Controlled Shipments

International Traffic in Arms Regulations (ITAR) mandates data and articles pertaining to defense and military related technologies may only be shared with US persons unless authorization from the Department of State (DOS) is received or a special exemption is used.

ITAR is a set of US Government regulations that control export, import, and temporary movement of defense-related articles and services on the United States Munitions List (USML). The DOS interprets and enforces ITAR to safeguard US national security and further US foreign policy objectives. All US exporters and brokers are required to register with US DOS to provide the US Government with necessary information on who is involved in certain manufacturing and exporting activities.

Shipments subject to International Traffic in Arms Regulations (ITAR) require filing Electronic Export Information (EEI) to obtain an Internal Transaction Number (ITN) from the US Government regardless of value per Department of State 22 CFR 123.22 Filing, retention, and return of export licenses and filing of export information.

Buyer agrees that it will not export, directly or indirectly, products to any country or foreign national for which the United States Department of Commerce, Department of State or any other agency of the United States, at the time of the export requires an export license, permit, authorization or other governmental approval from the applicable agency. Buyer also agrees that it will not conduct business activities without the authorization of the United States government with countries and political regimes restricted by the Office of Foreign Assets Control Country Sanctions Programs, see http://www.treasury.gov/resource-center/sanctions/Programs/Pages/Programs.aspx; as well as those individuals and entities set forth on the Entity List, the Denied Persons List, the Unverified Persons List, the Specially Designated Nationals List, the AECA Debarred List and the Nonproliferation Sanctions list available at http://export.gov/ecr/eg_main_023148.asp
